This Privacy Notice contains rights and obligations and other important provisions regarding collecting and processing of your personal data in the course of registration and participation.
The processing of the personal data listed here in the context of this notice is based on your voluntary and informed consent. Your or your company’s participation in the AustrianStartups Awesomeness Award (referred to as “AAA”) is subject to your consent to the processing of your personal data by AustrianStartups as explained here. You may withdraw this consent at any time without giving reasons.. Please note, however, that the revocation of your consent to the processing of your personal data by AustrianStartups will be considered your or your company’s withdrawal from the participation in the AAA.
We do not knowingly collect or store personal data from any person under the age of majority. Participation in AAA is not available for anyone under the age of eighteen.
If we become aware that we have collected personal information from individuals under the age of 18, we will delete that information as soon as possible.
1. Definitions
The following definitions are used:
(i) personal data: shall mean data relating to the data subject, in particular by reference to your name, phone number, email address and identification number or one or more factors specific to your physical, physiological, mental, economic, cultural or social identity as well as conclusions drawn from the data in regard to you;
(ii) your consent: shall mean any freely and expressly given specific and informed indication of your will by which you give your consent to personal data relating to you being processed fully or to the extent of specific operations;
(iii) your objection: shall mean a declaration made by you objecting to the processing of your personal data and requesting the termination of data processing, as well as the deletion of the data processed;
(iv) controller: shall mean natural or legal person or organization without legal personality which alone or jointly with others determines the purpose and means of data processing; makes and executes decisions concerning data processing (including the means used) or have it executed by a data processor;
(v) data processing: shall mean any operation or all of operations performed on the data, irrespective of the procedure applied; in particular, collecting, recording, registering, classifying, storing, modifying, using, querying, transferring, disclosing, synchronizing or connecting, blocking, deleting and destructing the data, as well as preventing its further use, taking photos, making audio or visual recordings, as well as registering physical characteristics suitable for personal identification (such as fingerprints or palm prints, DNA samples, iris scans).
As stated above, AustrianStartups is the data controller of any data which constitutes personal data and any uploads by the registration for and attendance of the AAA.
2. Purposes of the data processing
AustrianStartups will process the below personal data solely (i) to organize the AAA (ii) to assure your or your company’s participation in the AAA, (iii) to manage the election of the winner selected by experts, the jury, (iv) to post some information about you or your company on the websites of AustrianStartups www.austrianstartups.com and aaa.submit.to (hereinafter the “Websites”), furthermore (v) to send advertising and newsletters to the registered contestant, and (vi) for other direct marketing purposes.
3. List of personal data process
In order to achieve the above purposes, AustrianStartups processes the following personal data.
Your name, age, sex, e-mail address; your profile picture, notable activities, occupation and industry.
Provision of any personal data of third-person by you to AAA is subject to the collection of the appropriate consent of such third person by you to the processing of his/her personal data as described herein. That being said, by consenting to this notice, you hereby state and acknowledge that you obtained the appropriate consent from your or your company’s investor to provide AAA with investor’s personal data for the data processing activities described herein. AAA hereby excludes all responsibility relative to the existence of the appropriate consent from such investors or from any third parties to its data processing activities as explained in this notice.
4. Transfer of and access to personal data
The AAA processes the personal data by automatized methods and uses the following data processing services:
AAA Competition Platform (aaa.submit.to). AustrianStartups stores the personal data in the servers of AAA Competition Platform. As a condition of contestant’s participation in the AAA, the contestant will provide AAA the above-mentioned personal data to the jury and advisors in order to select the winner. The list of the above mentioned is available on the Websites.
5. Advertising and newsletter sending
Please note that by the registration and attendance of the AAA you or your company agree that AAA regularly sends advertising and newsletters by email to your provided email address given as part of the registration. If you or your company have given consent to receive newsletters from AAA to your or your company’s email address by its above-referred registration, you may freely withdraw your consent without any restriction and justification by using the Unsubscribe link at the bottom of the newsletter or by a declaration addressed to AAA, sent by post to the registered seat of AAA.
You agree that AAA shall be entitled, at their sole discretion, to publish advertisements and/or reports and/or other publications including that information received or obtained in relation to the AAA.
6. Data security
AAA & Alpha Awards performs tests regularly on the security systems of its servers. AAA fixes the discovered defects without delay; its software applies state of the art security solutions in order to ensure that not only its servers. Additionally, its software is protected against intrusion. Double factor authentication, the user identification solution and the software’s data transfer functions ensure the security of the stored data.
AAA acts with the utmost care in order to prevent data protection incidents. In the case of any data protection incident, the AAA’s Competition Platform provides maximum transparency to the contestants and the acting authorities.
7. Duration of data processing
AAA is required to process the personal data listed therein for no longer than is necessary for AAA to achieve the purposes for which such personal data was collected unless we are specifically required to keep such personal data longer by applicable law.
8. Your rights as data subject
Pursuant to the relevant provisions of the Information Act, you are entitled to access, verify and request the correction, deletion, and blocking of your personal data processed by AAA. For further information please contact AAA by sending an e-mail to award@austrianstartups.com or a physical mail to the above specified registered seat of AustrianStartups. AAA, as the data controller, provides you with the written, articulate information as soon as possible, latest within 30 days. This is free of any charge. You are entitled, at any time, to object or withdraw your consent to the data processing of AAA.
9. Changes to this Notice
If we change our privacy policies and procedures, we will post those changes on our website to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Notice shall come into force with immediate effect upon publication.
